LEGAL NOTICE
This website, www.terre-blanche.com (the "Website"), is published by D&O MANAGEMENT SAS, a simplified joint-stock company (SAS) with a capital of €49,081,400, whose registered office is located at 3100 route de Bagnols en Forêt, TOURRETTES (83440), FRANCE, registered with the DRAGUIGNAN Trade and Companies Register under number 492 843 230 00037, and whose VAT number is FR24 492 843 230.

Hereinafter referred to as "Terre Blanche."

2. DEFINITIONS
"GTC": Refers to these general terms and conditions of sale applicable to any reservation on the Website.
"Client": Refers to any individual of legal age with the legal capacity, acting for personal needs and for purposes that do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity.
"Reservation Confirmation": Refers to the confirmation email sent by Terre Blanche to the Client at the email address provided by the Client during the reservation. It contains a summary of the Reservation, specifying the reservation conditions (reserved services, price and applicable taxes, price of Additional Services, arrival and departure times, applicable rules for the reservation within Terre Blanche, reservation dates, guarantee).
"Personal Data": Refers to all data and/or information that can identify, directly or indirectly, an individual processed within the framework of the Website, and specifically as described in the Privacy Policy.
"Payment Provider": Refers to the provider offering a payment solution for the payment of a reservation made on the Website. Terre Blanche offers Saferpay as the main payment provider. The Client may opt for Alipay or GooglePay as alternatives if they do not wish to use the payment solution provided by Saferpay.
"Reservation": Refers to any purchase made on the Website for one of the services offered for sale by Terre Blanche.
"Services": Refers to accommodation, spa and treatments, restaurant, golf, or additional services provided by Terre Blanche.
"Additional Services": Refers to additional products and/or services offered to the Client when booking accommodation services (such as, for example, a bottle of champagne, bouquet of flowers, transfer between the airport and Terre Blanche, etc.).
"Golf Services": Refers to the golf activity offered at the various facilities and services provided by Terre Blanche.
"Restaurant Services": Refers to the catering services offered at Terre Blanche's various restaurants.
"Spa and Treatment Services": Refers to any services available at Terre Blanche's facilities.
"Accommodation Services": Refers to overnight stays offered by Terre Blanche, for the duration and on the dates selected by the Client, and under the conditions provided in these GTC and on the site.
"Website": As defined in Article 1 of these General Terms and Conditions.

3. GENERAL INFORMATION
3.1. Scope of Application
These General Terms and Conditions of Sale govern all sales of services offered by Terre Blanche to its clients on the website www.terre-blanche.com.

3.2. Acceptance
Any reservation made through the Website implies the consultation, acceptance, and unconditional consent of the Client to the full application of these GTC.
The Client acknowledges having read the GTC prior to making the reservation. As a result, the validation of the reservation constitutes acceptance of the GTC without any restrictions or reservations.
If any of the terms of the GTC are considered illegal or unenforceable by a court decision, the remaining provisions will remain in effect.
The applicable version of the GTC is the one in force on the Website at the time of the reservation.

3.3. Accessibility

These GTC are available and printable at any time via a hyperlink on the homepage of the Website. The Client can also save these gtc using the standard features of their computer.

3.4. Modifications

Terre Blanche reserves the right to modify these GTC at any time. They will then apply to all reservations made from the time they are posted on the Website. The Client must therefore consult and accept the GTC prior to any new reservation.
A printed version of the GTC, as well as any information sent by electronic means, will be accepted in any legal proceedings regarding the application of the GTC in the same manner and under the same conditions as any other written document kept in paper format.
These GTC are valid from March 13, 2025. They annul and replace all previous versions of these conditions as of this date.

3.5. Legal Capacity

The Client declares that they are an individual with legal capacity in accordance with Articles 1145 and following of the French Civil Code, able to contract and use the Website in accordance with the General Terms and Conditions of Sale and Website Use.

3.6. Precedence over Other Writings

These GTC are intended to govern the relationship between Terre Blanche and the Client, supplementing any written contract and addressing any issues that have not been the subject of a written agreement. These GTC take precedence over any other document issued by the Client, particularly any possible purchasing conditions, unless expressly agreed otherwise in advance by Terre Blanche. The fact that Terre Blanche does not invoke these GTC at any given time cannot be interpreted as a waiver to invoke them at a later date.

3.7. Purpose
The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the marketing by Terre Blanche of Services produced and provided directly by Terre Blanche, intended for Clients.

4. PRE-CONTRACTUAL INFORMATION

The Client expressly declares that they have been informed of the following information before making the Reservation, as part of the pre-contractual information provided to them, and more generally, that they have received from Terre Blanche all the relevant information needed for their consent and that the choice and purchase of Services are made at their sole responsibility and according to their needs.
The Client thus acknowledges having received, prior to making the Reservation and/or entering into the contract, in a clear and understandable manner, the present GTC and all the information listed in article L. 221-5 of the French Consumer Code, including in particular:
The essential characteristics of the Services;
The essential characteristics of the Additional Services;
The dates of the Services;
Prices including all taxes;
The validity period of the offers and their prices;
The General Terms and Conditions of Sale;
The possibility of resorting to a consumer mediator;
Information relating to the right of withdrawal;
The GTC.

5. SERVICES OFFERED

5.1. General Provisions
Terre Blanche offers the Client the opportunity to book various Services on the Website, the characteristics and specifics of which are described.
The photographs displayed on the Website are for illustrative purposes only. While every effort is made to ensure that the photographs, graphical representations, and texts reproduced to illustrate the Services provided by Terre Blanche give as accurate an overview as possible of the services offered, variations may occur, particularly due to changes in furniture or possible renovations.
In any case, Terre Blanche cannot be held responsible for any non-substantial errors that may occur in this regard.

5.2. Specifics Related to the Accommodation Service


5.3. Specifics Related to the Spa and Treatment Service


5.3.1 Access Hours

The pool is accessible from 8:00 AM to 8:30 PM during the opening period of Terre Blanche Hotel and from 7:30 AM for hotel guests who have made a Reservation for an Accommodation Service. It is accessible from 8:00 AM to 8:00 PM during the rest of the year.
The treatments are available from 10:00 AM to 7:00 PM.

5.3.2 Security Policy - Behavior

Access to treatments and massages is offered from the 4th month of pregnancy up to 8 and a half months.
The treatments offered by Terre Blanche Spa are intended for healthy individuals. A questionnaire must be completed for this purpose before any treatment. Terre Blanche Spa is a non-medical environment, and all treatments provided are solely aimed at the Client's well-being. The Client will inform Terre Blanche of any health issues, allergies, or injuries that could interfere with the proper conduct of treatments.
Children of the Client under 15 years of age are welcomed from 2:00 PM to 5:00 PM, provided they are accompanied by an adult with authority, including during their treatment. Aquatic and fitness areas are not accessible to children from July 1st to August 31st.
Wearing a swimsuit is mandatory in the wet areas (sauna, hammam, laconium). For access to the fitness area, a sports outfit and appropriate footwear are required.
In order to preserve the silence and harmony of the place, clients are requested to be mindful of the sound volume of certain electronic devices and avoid making noise.

5.3.3 Client Arrival
To fully enjoy the treatments, Terre Blanche recommends arriving 20 minutes before the session if the Client wishes to benefit from the facilities. Upon arrival, a bathrobe, a bath towel, and slippers will be provided to the Client.
The duration of the treatments indicated corresponds to the time of care and includes, in particular, dressing and undressing time, which is 5 minutes. A rest period is necessary during certain treatments. A late arrival will not result in an extension of the treatment time.

5.3.4 Cancellation
Any Reservation results in an obligation to pay the full price of the Spa and Treatment Service according to the rates in effect on the date of the Reservation.
The Client can cancel or modify their Reservation by contacting Terre Blanche, in accordance with the following cancellation policy:
Any change or cancellation must be communicated to the Terre Blanche Spa team at least 24 hours before the treatment begins.
After this period, any canceled treatment will be charged in full.

5.4. Specifics of Catering Services
Each Terre Blanche restaurant has its own accessibility conditions and hours, which are available on the dedicated page of the Website. To access this, the Client must go to the "Restaurants" section, then select "Our Restaurants," and click on "Discover" to select the Catering Service.
The General Terms and Conditions of Use for catering services are available when the Client is given the option to make an online reservation for a time slot. Under no circumstances is the Client required to make any payment during the online booking process.

5.5. Specifics of Golf Services
The Golf Services offered by Terre Blanche are available on the dedicated page of the Website. To access it, the Client must go to the "Golf" section, select the category of their choice, and click on "Discover" next to each Golf Service description.
Except for the Green Fee Reservation described in article 7.4 of these General Terms and Conditions, which is made on the Website, other reservations by the Client must be made by contacting the Terre Blanche Golf team via email at: albatros@terreblanchegolf.com.

6. PRICES

6.1. Internet Connection

Using the Website requires an Internet connection and a device that allows access to the Internet. The Client is solely responsible for the telecommunication costs related to accessing the Website, which depend on their subscription to their Internet service provider.

6.2. Price

The final price is stated in euros, all taxes included (TTC), and includes, for Accommodation Service Reservations, the tourist tax. However, in some cases, additional fees must be paid directly on-site in the event of purchasing other services not reserved during the booking.
The price does not include transportation or on-site transport unless it is a Complementary Service selected by the Client, nor personal expenses.
The price for Services is understood to be per room, suite, or villa, for the number of people declared by the Client and, if applicable, for any Complementary Services selected by the Client during the Reservation.
Terre Blanche may modify the prices displayed on the Website at any time and without notice. However, modified prices will only apply to bookings made after the new prices come into effect.

7. RESERVATION


7.1. If it is a Reservation for Accommodation Services with or without Spa and Treatment Services, Golf Services, or Complementary Services


7.1.1. To book on the Website

To make a reservation for Accommodation Services, the Client must:
Access the Terre Blanche website via the URL: https://www.terre-blanche.com/;
Click on the "Book" button at the top right;
Select "Accommodation" from the drop-down menu;
Select the desired check-in date, check-out date, number of adult and child clients, and, if applicable, a promotional code;
Click on the "Check availability" button;
Select the desired room, suite, or villa based on the available options;
Select any Complementary Services if applicable.
Complementary Services are selected by the Client during the Reservation and are invoiced at that time. If they are date-specific, the date must be specified when selecting the relevant Complementary Service. The conditions for modification and cancellation of these services are the same as those specified in Article 13.
A deposit equal to the cost of one night's stay will be required at the time of the Reservation to validate and confirm the booking with Terre Blanche.

7.1.2. To finalize the Reservation

In the shopping cart, a summary of the Reservation will appear. Check the details of the Reservation and, if necessary, correct any errors;
Enter all required information in the "Contact Information" form;
Read the General Terms and Conditions of Sale (GTC);
Declare that you have read and accepted the GTC by checking the box "I have read and accepted the General Terms and Conditions of Sale and agree to them without reservation";
Check the box to accept the privacy policy;
Click on the "Confirm Reservation" button;
Provide the billing information required by the payment provider Saferpay or any other payment provider chosen by the Client;
Click on "Buy" to finalize the contract with Terre Blanche;
Follow the payment provider's instructions.
Any Reservation made on the Website is a reservation with a payment obligation.
Any Reservation constitutes acceptance of the prices and descriptions of the Accommodation Services and Complementary Services available for Reservation.

7.2. If it is a Reservation for Spa and Treatment Services

To make a reservation for Spa and Treatment Services, the Client must directly contact Terre Blanche by email or phone according to the information provided on the dedicated page. For Spa and Treatment Services titled "Packages," this reservation can, however, be initiated via the Website. The Client must:
Access the Terre Blanche website via the URL: https://www.terre-blanche.com/;
Click on the hamburger menu at the top left;
Select "Spa & Wellness";
Select "Packages";
Choose the desired Spa and Treatment Service from the available options;
Click on the "Book" button.
The reservation process continues as follows: sending an email to the address reception.tbspa@terreblanchehotelspa.com. The Terre Blanche Spa team will contact the Client to confirm the Reservation, based on availability and the services offered, as well as payment for the Spa and Treatment Services.

7.3. If it is a Reservation for Catering Services

To make a reservation at one of the restaurants listed on the Website, the Client must:
Access the Terre Blanche website via the URL: https://www.terre-blanche.com/;
Click on the hamburger menu at the top left;
Select "Restaurants";
Select "Our Restaurants";
Select the desired restaurant from the available options for online reservation by clicking on "DISCOVER";
Click on the "Reservation request" button;
Select the desired number of covers;
Select the desired date from the displayed availability;
Select the desired time from the available time slots.
To finalize the Reservation, the Client must:
Click on the "Book" button;
Follow the instructions of the "Zenchef" booking platform.
It is specified that this reservation is free of charge and does not obligate the Client to make any payment.

7.4. If it is a Reservation for Golf Services

The Client can make an online reservation for their green fee, which is subject to payment, via the Chronogolf by Lightspeed booking platform. To do so, the Client must:
Access the Terre Blanche website via the URL: https://www.terre-blanche.com/;
Click on the "Book" button at the top right;
Select "Green Fee" from the drop-down menu;
Select the desired date, courses, number of players, and desired time slot.
To finalize the Reservation, the Client must:
In the shopping cart, a summary of the Reservation will appear. Check the details of the Reservation and, if necessary, correct any errors;
Log in and/or create an account on the Chronogolf by Lightspeed booking platform;
Follow the instructions of the booking platform, whose Terms of Use are available via the URL: https://www.chronogolf.fr/page/terms_and_conditions.
For golf subscriptions and services other than green fees, the Client must contact the Terre Blanche golf team using the contact details on the dedicated page.

7.5. Confirmation of the Reservation
The Client has the option to print the booking confirmation corresponding to their Reservation.
Terre Blanche will acknowledge receipt of the Reservation once it has been validated by sending a confirmation email. The Client agrees that the reservation registration systems serve as proof of the purchase and its date. By keeping this email and/or printing it, the Client holds proof of the Reservation, which Terre Blanche recommends keeping.
Once the price of the reservation has been paid by the Client, a Reservation Confirmation email will be sent to the email address provided by the Client.

8. PAYMENT TERMS

8.1. Payment Date
The payment for the Reservation is due at the time of the Reservation. Payment, as per this article, is considered to have been made when the funds are effectively made available to Terre Blanche.
Payment is made by credit card only.
Payments are not considered final until the funds owed are actually received by Terre Blanche.
Any amount paid in advance constitutes a deposit and not a down payment as defined in Article L.214-1 of the Consumer Code.
The balance of payment will be requested thirty (30) days before arrival at Terre Blanche.

8.2. Payment Methods

The Client may pay for the Reservation online and/or the deposit via the Payment Solution provided during the Reservation confirmation by the Payment Provider for both Accommodation Services and any other Services that can be booked online.
Payment will be made by credit card: Visa, Mastercard, American Express, Union Pay, or Maestro.
The Client acknowledges having read and accepted the general terms and conditions of the Payment Provider as well as their personal data processing terms, available at the following address: https://worldline.com/en-ch/home/main-navigation/solutions/merchants/solutions-and-services/e-commerce/saferpay-payment-solution.
The Client guarantees to Terre Blanche that they have all the necessary authorizations to use the chosen payment method.
Terre Blanche will take all necessary measures to ensure the security and confidentiality of data transmitted online during the payment process on the Website.
It is specified that all payment-related information provided on the Website is transmitted to the bank and is not processed on the Website.

9. NO RIGHT OF WITHDRAWAL

Article L. 221-28, 12°, of the Consumer Code states: "The right of withdrawal cannot be exercised for contracts: (…) 12° For services of accommodation, other than residential accommodation, transport of goods, car rentals, catering, or leisure activities that must be provided on a specific date or during a specific period."
As a result, the right of withdrawal does not apply to the Reservation of Services.

10. ASSIGNMENT OF CONTRACT

The Contract is concluded based on the Client identified in the Contract and is therefore non-transferable.

11. MODIFICATION OF THE CONTRACT

Any modification of the Reservation by the Client, whether it concerns the date, duration, or Services, after the Confirmation of the Reservation, is subject to the express acceptance of Terre Blanche. If applicable, additional charges may apply.

12. CANCELLATION TERMS

12.1. By Terre Blanche
In certain cases, such as non-payment, incorrect contact information, or any other issue related to the Reservation, Terre Blanche reserves the right to block the Reservation until the issue is resolved.
The Client will be informed by email at the address provided during the Reservation on the Website.
Given the increase in frauds associated with online sales, and to secure payments, for any Reservation made on the Website, Terre Blanche may conduct a review of the Reservation before confirming it.
Terre Blanche reserves the right to cancel any Reservations that are non-compliant or suspicious, for legitimate reasons, particularly if the Reservation originates from a Client with whom there is any existing dispute.
In case of cancellation by Terre Blanche, except for an imperative reason justified by the Client’s failure to meet their contractual obligations, the Client will be refunded all amounts paid, and may, if applicable, receive compensation depending on the actual damage incurred and justified.

12.2. By the Client


12.2.1. Cancellation Period

Cancellations must be made directly with Terre Blanche. In general, any cancellation made more than thirty (30) days before the Service date is possible and free of charge, unless a different time frame is specified during the Reservation.
In this case, the full amount paid will be refunded to the Client.

12.2.2. Late Cancellation

However, if the cancellation is made late—i.e., less than thirty (30) days before the Service date, or after the exceptional period indicated by Terre Blanche during the Reservation—Terre Blanche will retain 100% of the amounts paid by the Client and reserves the right to resell the Reservation canceled by the Client.

12.2.3. Exceptional Cancellation Policy

Terre Blanche reserves the right to apply an exceptional cancellation policy (time frames and amounts charged depending on late cancellation) for certain Reservations. This exceptional cancellation policy is described in the Reservation summary. An example is provided below:

CANCELLATION POLICY:

Cancellation or modification is possible up to 3 days before the arrival date. After that, 50% of the total stay will be kept. In case of early departure, no-show, or cancellation on the arrival day, the originally reserved stay must be paid in full.
If you cancel your booking from D-3 (local hotel time), 50% of the total stay will be charged.
If you cancel your booking from D-1 (local hotel time), 100% of the total stay will be charged.

12.3. Interruption of Reservation Execution

In case of interruption of the Reservation execution by the Client for any reason, including behavior contrary to the rules outlined in Articles 5.2 to 5.5 above, the Client will be required to pay Terre Blanche 100% of the amounts due for the Reservation as stated in the Reservation Confirmation email. No refund will be granted for this reason.

12.4. Client No-Show

In case of no-show by the Client on the date of Service, Terre Blanche will be entitled to charge the cancellation fees as outlined in Article 12.2 of these General Terms and Conditions. Terre Blanche reserves the right to resell the affected Services.

13. LIABILITY

Terre Blanche is fully responsible for the Services booked by Clients under these General Terms and Conditions.
However, Terre Blanche can be exempted from liability if it proves that the non-performance or poor performance of the Services is attributable either to the Client, to an unforeseeable and insurmountable third party, or to force majeure.

14. INTELLECTUAL PROPERTY

The overall structure of the Website, as well as the texts, graphics, images, databases, data, sounds, and videos it contains (hereinafter "Content"), are the property of Terre Blanche. Any representation and/or reproduction and/or exploitation, in whole or in part, and/or substantial or non-substantial extraction of the Content and/or the Services offered on the Website, by any means, without the prior written authorization of Terre Blanche, is strictly prohibited and could constitute infringement and/or an act of unfair competition.
The "Terre Blanche" trademark is a protected trademark. Any representation and/or reproduction and/or exploitation, in whole or in part, of this trademark, of any kind, is strictly prohibited.

15. EVIDENCE AGREEMENT

Data stored on computer or electronic media constitutes admissible and opposable evidence in the same way and with the same probative force as any document received and kept in writing.
In all cases, the online submission of the credit card number and the final validation of the Reservation will serve as proof of the entire Reservation in accordance with Article 1366 of the Civil Code and will require the payment of the sums due for the Reservation.

This validation constitutes a signature and express acceptance of all operations performed on the Website. However, in case of fraudulent use of your credit card, the Client is encouraged to contact Terre Blanche immediately after detecting such use by calling the number provided in Article 1 of these Terms or in the legal notices available on the Website.
The computerized registers, stored in Terre Blanche's computer systems under reasonable security conditions, will be considered as proof of the Reservations and payments made between the Client and Terre Blanche.
Archiving of Reservations and invoices is done on a reliable and durable medium in accordance with Article 1379 of the Civil Code.
Terre Blanche ensures the preservation of the document that records a Reservation and guarantees the Client access to it at any time upon request, for 10 (ten) years.

16. PERSONAL DATA PROTECTION

For any questions regarding the transmission, confidentiality, and purposes of the processing that Terre Blanche undertakes on the Client's personal data, Terre Blanche invites the Client to refer to the Privacy Policy available on the Website at the following address: https://www.terre-blanche.com/fr/informations/utilisation_donnees_personnelles_cpa286_3193.htm

17. APPLICABLE LAW, DISPUTE RESOLUTION, MEDIATION

17.1. Applicable Law

Subject to the mandatory provisions of the law applicable to the Client in the absence of this clause, these General Terms and Conditions (GTC) are governed by French law.
In case of a dispute, Terre Blanche will make every effort to resolve it amicably. The Client is encouraged, prior to any legal action, to contact the management of Terre Blanche Hotel Spa Golf Resort ***** at the postal address listed on its homepage on the Website or in the legal notices of these GTC.
The Client is informed that they can, in any case, resort to consumer mediation and any alternative dispute resolution method (such as conciliation) in the event of a dispute.
In case of failure to reach an amicable resolution, and in accordance with the provisions of the Consumer Code regarding amicable dispute resolution, the Client may use the free mediation service of Médiation Tourisme et Voyage:

This mediation process is entirely free of charge, and Terre Blanche will bear the costs of mediation. However, the Client may be assisted, at their own expense, by a counselor or an expert, as may Terre Blanche. Mediation is not mandatory, and the Client may withdraw from the process at any time, just as Terre Blanche may.

17.3. Jurisdiction

The competent court will be the Commercial Court of Draguignan in the event of a dispute between merchants and related persons (companies, branches, etc.), and will be the court of the defendant's domicile in case of a dispute with a consumer Client or, at the claimant's choice, the location where the service was provided in other cases.
